Brand Guard — Privacy Policy

1. Introduction

This Privacy Policy explains how SHINFU HOLDINGS PTE. LTD. (UEN: 202606018H) (“we”, “us”), the operator of Brand Guard (brandguard-ip.com), collects, uses, discloses and protects personal data in accordance with the Singapore Personal Data Protection Act 2012 (“PDPA”).

2. Personal data we collect

We collect personal data that you provide to us, including: your name, company name, email address and contact details; details of the trade mark you wish to register and of the applicant (which may include an individual applicant’s name and address); billing and payment information (processed by our payment provider — we do not store full card numbers); and correspondence between you and us. We also collect limited technical data (such as IP address and browser information) when you use our website.

3. Purposes

We use personal data to: provide the services you request, including preparing and filing trade mark applications with the Intellectual Property Office of Singapore (“IPOS”) and corresponding with IPOS on your behalf; deliver pre-filing reviews and registrability assessments; process payments and issue invoices; communicate with you about your matter, including deadlines and renewals; comply with our legal and regulatory obligations; and operate and improve our website. We will not use your personal data for unrelated purposes without your consent.

4. Disclosure of personal data

We disclose personal data only as needed for the purposes above, to: IPOS, as part of a trade mark application or related proceeding (note that applicant details contained in a filing become part of the public trade mark register); our payment processing, cloud hosting and IT service providers, under obligations of confidentiality; and professional advisers or authorities where required by law. We do not sell personal data.

5. Overseas transfers

Your personal data may be accessed by our personnel or processed on systems located outside Singapore (including Japan) in connection with the provision of the services. Where personal data is transferred outside Singapore, we take steps to ensure it receives a standard of protection comparable to that under the PDPA, as required by section 26 of the PDPA.

6. Retention

We retain personal data for as long as necessary for the purposes for which it was collected, including the ongoing management of your trade mark (such as renewal reminders), and thereafter as required for legal, regulatory or record-keeping purposes, after which it is securely deleted or anonymised.

7. Security

We implement reasonable administrative, technical and physical safeguards to protect personal data in our possession against unauthorised access, collection, use, disclosure, or similar risks, including access controls and encrypted transmission.

8. Access and correction

You may request access to or correction of your personal data in our possession, or withdraw consent to our continued use of it, by contacting our Data Protection Officer using the details below. Withdrawal of consent may affect our ability to continue providing the services. We will respond to requests within a reasonable time in accordance with the PDPA.

9. Cookies

Our website uses cookies and similar technologies necessary for its operation and for basic analytics. You can control cookies through your browser settings; disabling them may affect the functioning of parts of the website.

第1条（はじめに）

本プライバシーポリシーは、Brand Guard（brandguard-ip.com）の運営者である SHINFU HOLDINGS PTE. LTD.（UEN: 202606018H、以下「当社」）が、シンガポール個人情報保護法2012（以下「PDPA」）に従って個人情報をどのように収集、利用、開示および保護するかを説明するものです。

第2条（収集する個人情報）

当社は、お客様からご提供いただく個人情報を収集します。具体的には、お名前、会社名、メールアドレスおよびご連絡先、登録をご希望される商標および出願人に関する情報（個人の出願人の場合、氏名および住所を含むことがあります）、請求および支払いに関する情報（当社の決済事業者が処理します。当社はカード番号の全桁を保存しません）、ならびにお客様と当社との間の連絡内容です。また、ウェブサイトのご利用時に、IPアドレスやブラウザ情報などの限定的な技術情報を収集します。

第3条（利用目的）

当社は、個人情報を次の目的で利用します。お客様がお申し込みになったサービスの提供（シンガポール知的財産庁（以下「IPOS」）への商標出願の準備・実施、およびお客様に代わって IPOS と連絡を行うことを含みます）、出願前レビューおよび登録可能性評価の提供、支払いの処理および請求書の発行、期限や更新を含む案件に関するご連絡、法令および規制上の義務の遵守、ならびに当社ウェブサイトの運営および改善です。当社は、お客様の同意なく、これらと関係のない目的に個人情報を利用することはありません。

第4条（個人情報の開示）

当社は、上記の目的のために必要な範囲でのみ個人情報を開示します。開示先は、商標出願または関連手続の一部としての IPOS（出願に含まれる出願人情報は、公開される商標登録原簿の一部となる点にご留意ください）、守秘義務を負う当社の決済処理・クラウドホスティング・IT サービスの提供事業者、および法令上必要とされる場合の専門家または当局です。当社が個人情報を販売することはありません。

第5条（国外への移転）

お客様の個人情報は、本サービスの提供に関連して、シンガポール国外（日本を含みます）に所在する当社の担当者がアクセスし、または国外のシステム上で処理されることがあります。個人情報をシンガポール国外に移転する場合、当社は PDPA 第26条の定めに従い、PDPA と同等の水準の保護が確保されるよう措置を講じます。

第6条（保有期間）

当社は、収集の目的（更新のご案内など、お客様の商標の継続的な管理を含みます）のために必要な期間、その後は法令上・規制上・記録保持上必要とされる期間に限り個人情報を保有し、その後は安全に削除または匿名化します。

第7条（安全管理措置）

当社は、保有する個人情報を不正なアクセス、収集、利用、開示その他これらに類するリスクから保護するため、アクセス制御や通信の暗号化を含む、合理的な組織的・技術的・物理的な安全管理措置を実施します。

第8条（開示および訂正の請求）

お客様は、当社が保有するご自身の個人情報について、開示または訂正を請求し、あるいは継続的な利用に対する同意を撤回することができます。ご請求は、下記のデータ保護責任者までご連絡ください。同意を撤回された場合、当社が本サービスの提供を継続できなくなることがあります。当社は、PDPA に従い、合理的な期間内にご回答いたします。

第9条（クッキー）

当社ウェブサイトは、その運営および基本的な分析に必要なクッキーおよび類似の技術を使用します。クッキーはブラウザの設定で制御できますが、無効にした場合、ウェブサイトの一部の機能が正常に動作しないことがあります。
